Notice is hereby given that a Regular Meeting of the Governing Body of the City of Natalia will be held on the 20th of February
2012 at 7:00 p.m. at the Natalia City Office Building, 2078 State Hwy 132 North, Natalia, Texas at which time City Council of the City of Natalia, Texas shall consider, discuss, review and may take possible action on the following subjects:

The City Council of the City of Natalia reserves the right to adjourn into executive session at any time during the course of this meeting to discuss any of the matters listed above, as authorized by the Texas Open Meetings Act, Texas Government Code 551.071 (Consultation with Attorney: pending or contemplated litigation); 551.072 (Deliberation about Real Property), 551.073 (Deliberations about Gifts and Donations); 551.074 (Personnel Matters); 551.076 (Deliberation about Security Devices); 551.086 (Certain Public Power Utilities; competitive Matters); and 551.087 (Economic Development); and any other provision under Texas law that permits a governmental body to discuss a matter in a closed executive session.

A RESOLUTION OF THE SOUTH TEXAS REGIONAL WATER ALLIANCE REGARDING THE PROPOSED INCREASE IN EDWARDS AQUIFER AUTHORITY MANAGEMENT FEES
WHEREAS, the Edward Aquifer Authority ( EAA) recently informed all EAA groundwater withdrawal permit holders of significant increase in EAA management fees for the year 2012 and beyond; and
WHEREAS, the EAA states that the increase in management fees is largely due to the anticipated costs associated with the implementation of a Habitat Conservation Plan (HCP); and
WHEREAS, the HCP is expected to be recommended by the Edwards Aquifer Recovery Implementation Program (EARIP) steering committee for the preservation of the natural habitats of certain aquifer-dependent endangered species as required by the Edwards Aquifer Authority Act and the federal Endangered Species Act; and
WHEREAS, the EARIP a stakeholder group created by the 2007 Texas Legislature to represent the region's diverse interests, with a mandate to undertake a consensus-driven process to identify solutions to safeguard the habitats of federally-listed species, specifically those around the Comal and San Marcos springs ecosystems; and
WHEREAS, to recommend a plan of action acceptable to the United States Fish and Wildlife Service (USFWS) that would result in the issuance of an incidental take permit adding greater certanity of the availablity of Edwards Aquifer groundwater in the future by minimizing any potential for legal action against groundwater users; and
WHEREAS, this plan would identify costs to all ground water uses and well as downstream users in a fair and equitable manner and would require the EAA to begin collecting aquifer management fees in 2013 from all users (pumpers and downstream) to ensure the "plan" once approved by the Federal Government and implemented in 2013 would be sufficient to cover the costs.
NOW, THEREFORE, BE IT RESOLVED that the South Texas Regional Water Alliance:
1.) Supports the fair and equitable costs for all consumers (pumpers and downstream users) and opposes any proposed increase of management fees for the implementation of the HCP without using a fair and equitable costs
2.) Supports the continuation of the Edwards Aquifer Management Fee Rebate Program.
3.) Supports the continuation of the Edwards Aquifer Authority and the Edwards Aquifer Recovery Implementation Program Implementation Program in seeking State funding to support the HCP.
